High court rejects Brimer request
The Texas Supreme Court has rejected a request by state Sen. Kim Brimer to review the eligibility of Wendy Davis, his Democratic challenger in the November election, officials said this afternoon.
The rejection came today as the high court declined to intercede in the pending case, and knock Davis off the ballot before Friday’s deadline for changing the ballot, as Brimer, R-Fort Worth, had requested.
Brimer’s challenge to Davis’ candidacy is currently pending in the 2nd Court of Appeals. Brimer contends Davis is ineligible to run because she was technically still a member of the Fort Worth City Council when she filed for the Senate seat.
Last month, state district Judge Tom Lowe of Fort Worth ruled against a similar challenge by Brimer, who then filed an appeal. Davis’ candidacy had earlier been the subject of an unsuccessful court challenge filed by firefighters who Davis accused of being Brimer supporters.
In a statement late this afternoon, Brimer’s campaign said they welcomed the Supreme Court’s decision: “We will continue to campaign aggressively while the (2nd Court of Appeals) continues in its process to ensure all candidates in this race are eligible.”
No word on what’s next from either side in this hotly contested race.

Wendy needs to get out of the race. She has a huge ego and needs to go back home.
