The Fourth Court of Appeals in San Antonio on Wednesday affirmed an Angelina County jury’s finding of guilt and its life sentence against a Lufkin nurse who injected dialysis patients with bleach, killing at least five of them.

Attorneys for Kimberly Saenz, a former DaVita Dialysis Clinic nurse sentenced to life without parole in April 2012, contended that the jury received erroneous instruction that caused “egregious harm” to Saenz’s defense. They said the capital murder charge against Saenz did not require jurors to specify which of five patients they believed she killed — only that they believed she killed at least two of the five, which satisfied the definition of capital murder, according to previous reports.
